OUR ETHICAL Sourcing POLICY     

1 Purpose 

The purpose of this policy is to ensure that Pacific Fresh Pty Ltd is: 

  • To uphold and protect human rights of its employees. 

  • Sourcing its products and services in a reasonable manner 

  • Working with its suppliers to improve their social and environmental practices. 

  • Providing clear guidance to its buying staff, and 

  • Protecting its corporate reputation, the reputation of the business and the company’s brands 

 

2 Commitment 

Pacific Fresh is committed to upholding human rights, fair working conditions and environmental protection in accordance with the expectations or our community, and the requirements of the law. 

This policy has been developed to compliment the company’s core values of integrity, trust and acting responsibly through maintaining a reputation for the highest legal, moral and ethical standards in all dealings with customers and key stakeholders. The management is also committed to working with its suppliers to help improve their labour and environmental practices. 

 

3 Expectations 

Pacific fresh Pty Ltd expects its suppliers to support the ethical standard set out in this policy with regards to workplace safety, environment, and fair pay and employment conditions.  The management recognize that full compliance with these criteria may take time for suppliers. 

 

4 Labour Rights  

  • Employment is freely chosen 

  • There is no forced, bonded or involuntary prison labour 

  • Workers are not required to lodge deposits or their identity papers with their employer and are free to leave their employment after reasonable notice. 

 

5 Freedom of association and the right to collective bargaining are respected 

  • Workers, without distinction, have the right to join or form trade unions of their own choosing and to bargain collectively. 

  • The employer adopts an open attitude towards the activities of trade unions and their organizational activities. 

  • Workers representatives are not discriminated against and have access to carry out their representative functions in the workplace 

  • Where the right to freedom of association and collective bargaining is restricted under law, the employer facilities, and does not hinder, the development of parallel means for independent and free association and bargaining 

 

6 Working Conditions 

  • A safe and hygienic working environment shall be provided, bearing in mind the prevailing knowledge of the industry and of any specific hazards.  Adequate steps shall be taken to prevent accidents and injury to health in the working environment. 

  • Workers shall receive regular and recorded health and safety training, and such training shall be repeated for new or reassigned workers. 

  • Access to clean toilet facilities and to clean and drinkable water and, if appropriate, sanitary facilities for food storage shall be provided 

  • Suppliers will ensure that personal protective equipment is available, and workers are trained in its use.  Safeguards on machinery must meet or exceed local laws. 

  • Suppliers shall assign responsibility for health and safety to a senior management representative. 

  • Worker can report any potential hazards in the workplace, refer to Appendix E.1 Hazard Report, or to iAuditor app through QR code provided in the lunchrooms. 

 

7 Living Wages 

  • Wages and benefits paid for a standard working week met, at a minimum, national legal standards or industry benchmark standards, whichever is higher.  In any event wages should always be enough to meet basic needs and to provide some discretionary income. 

  • All workers shall be provided with written and understandable information about their employment conditions in respect to wages before they enter employment and about the particulars of their wages for the pay period concerned each time they are paid. 

  • Deductions from wages as a disciplinary measure or any deductions from wages not provided for by Law shall not occur without the expressed permission of the worker concerned.  All disciplinary measures should be recorded. 

 

8 Working Hours 

  • Working hours comply with any Law and National Employment Standards, whichever affords greater protection. 

  • In any event, workers shall not on a regular basis be required to work in excess of 48 hours per week and shall be provided with at least one day off for every 7 day period on average.  Overtime should be voluntary, shall not be excessive, shall not be demanded on regular basis and shall always be compensated at a premium rate. 

 

9 Regular Employment 

  • To every extent possible work performed must be based on recognized employment relationship established through national law and practice. 

  • Obligations to employees under labour or social security laws and regulations arising from the regular employment relationship shall not be avoided using labour only contracting, subcontracting, or home-working arrangements, or through apprenticeship schemes where there is no real intent to impact skills or provide regular employment, nor shall any such obligations be avoided through the excessive use of fixed-term contracts of employment. 

 

10 Entitlement to Work and Immigration 

  • Only workers with a legal right to work in Australia shall be employed or used by the supplier 

  • All workers, including employment agency staff must be validated by the supplier for their legal right to work by reviewing original documentation or through VEVO checks 

  • The supplier shall implement processes to enable adequate control over agencies with regards to the above points and related legislation. 

 

11 Sub-Contracting 

  • There shall be no sub-contracting unless previously agreed with Pacific Fresh Pty Ltd 

  • Suppliers must have adequate processes in place for properly managing sub-contracting to ensure sub-contractors do not abuse, exploit, or provide unsafe working conditions for their employees. 

  

12 No Harsh or inhumane Treatment Policy 

  • Pacific Fresh Pty Ltd has Zero Tolerance in Bullying, Harassment and Sexual harassment  

  • Pacific Fresh Pty Ltd will treat complaints seriously and will deal with them promptly, impartially and confidentially 

  • All workers are encourages to cooperate fully to help create and maintain a pleasant, productive, harassment-free working environment for all. 

 

13 Discrimination Policy 

Pacific Fresh Pty Ltd has zero tolerance in discriminating acts upon all employees.  The company has an obligation to not take adverse action against an employee or prospective employee in hiring, compensation access to training, promotion, or retirement based on race, caste, national origin, religion, age, disability, gender, marital status, sexual orientation, pregnancy, union membership or political affiliation. 

 

14 Child Labour Policy 

  • Child labour is defined as work that deprives children of their childhood, the opportunity to attend school and fulfil their potential, or that is harmful to their physical and mental development. 

  • Pacific Fresh will not with suppliers who use child labour. 

15 Statement of Business Ethics 

Our company is committed in doing business with integrity, trust, transparency, and accountability.  The company will continue to uphold its values, and to develop and maintain a work environment that adheres to business ethics standards set by Pacific Fresh Pty Ltd. 

All service contractors and subcontractors are expected to comply with the Pacific Fresh Business Ethics statement.  Commercial partners and suppliers are responsible for making any of their subcontractors aware of this statement. 

This statement of business ethics applies to permanent, temporary, and casual employees, consultants, contractors, and agency employees engaged to perform work for or on behalf of Pacific Fresh Pty Ltd 

Pacific Fresh Pty Ltd and commercial partners, contractors, sub-contractors and suppliers will maintain business relationships based on open and effective communication, respect and trust, and adopt a non-adversarial approach to dispute resolution. 

All employees, clients, stakeholders, contractors, suppliers and service providers shall not engage in any acts of bribery and corruption, fraud or falsification of documents and records, and other forms of serious wrong doings. 

All stakeholders, commercial partners, employees and suppliers are required to report all information that they become aware of that they honestly believe, on reasonable grounds, shows or tends to show, serious wrongdoing inside or outside the Pacific Fresh’s business. 

 

All stakeholders of Pacific Fresh Pty Ltd are encouraged to co-operate fully to help create and maintain a pleasant, productive, harassment-free working environment.
